For Trial Courts - As of June 27, 2016, the EFM will begin to calculate the following fees automatically based on the appropriate parties being added by the filer. The system will calculate the following fees:

 - Civil Service Fee: $10.00 per defendant after the first defendant. The filer should add any and all defendants in civil cases when creating cases or filing in to existing cases.

 - Small Claims Service Fee: $10.00 for each defendant. The filer should add any and all defendants in civil cases when creating cases or filing in to existing cases.

 - Civil Garnishee Fee: $10.00 for each garnishee defendant beyond the third garnishee defendant. The filer should ensure that all garnishee defendants are added when filing subsequent filings.

 - Small Claims Garnishee Defendant: $10.00 for each garnishee defendant beyond the third garnishee defendant. The filer should ensure that all garnishee defendants are added when filing subsequent filings.

 Because these fees can no longer be added manually, when filing into a new or existing case, you must ensure that you add any and all defendants/garnishee defendants as parties to the case so that they properly receive service and that you pay the correct service fees.

The fees listed above will be removed as optional service fees.

Indiana Code 33-37-4 and 33-37-5 currently require these fees be assessed. We will be requesting the General Assembly to amend certain statutes to bring them in line with new e-filing service provisions; meantime please be aware of the automatic calculations as described above.
