How to Request letters testamentary?

Question: Hi, I am ready to request letters testamentary in the case I filed through your service but I am having trouble finding the correct place to request them.  Where do I request them?.  Thank you!

Answer: That depends on into which county probate court you are eFiling, Harris County or all others:

Probate courts in all other counties -

  • Create a cover letter. The format of it is unimportant. You just need something to upload,
  • Choose a Filing Code of Requests on page 2 of the eFiling process.
  • Upload your cover letter as the lead document.
  • Under Additional Court Services check "Issue Letters Testamentary, Guardianship, or Administration"
  • Make sure you request the correct number of letters.
  • Complete your submission in the normal manner.

Harris Count Probate Court -

  • Create a cover letter. The format of it is unimportant but mention that you need [number] of letters testamentary. You just need something to upload,
  • Choose a Filing Code of Requests on page 2 of the eFiling process.
  • Upload your cover letter as the lead document.
  • There is no option to select for Letters Testamentary so you have to pay for them indirectly:
  • The cost of a letter testamentary is $2. Click to select Copies-Non Certified at $1 a page. Order two copies for each letter testamentary.
  • Complete your submission in the normal manner.
