How to pay an unpaid eFiling Fee?

Question: I filed a contempt last week which the clerk accepted then notified me that I had not paid the filing fee.  Do I have to refile or just send a letter with payment?

Answer: No, do you not need to refile the document. You have two choices on how to pay the outstanding fee:

  1. Mail a check to the clerk for amount specified or
  2. Submit an eFiling for the case. Select Motion for Contempt as the Filing Code and upload a cover letter as your lead document. It would be wise to add a note to the clerk that the fee is for the amount owed for the previous filing (provide the Envelope/Submission ID number).

Regarding your unasked question of how this could have happened: You probably selected the incorrect Filing Code so the fee for your contempt document and the intake clerk probably was not paying attention.

Usually, the clerks Return a Filing for Correction in situations like this.

If this is what happened, the clerk's office must have picked up on the missing fees during some kind of audit.
